What Are 1094 and 1095 Forms?
The Affordable Care Act has a requirement that 1094 and 1095 forms have to be filed starting in 2016. These forms are mainly required for larger businesses that offer insurance and coverage and have more then 50 full time employees. For businesses with less then 50 fulltime employees insurance companies will send employees these forms and file them with the IRS.
The exception to this is if you have under 50 employees and provide self insured coverage (ie: the employer pays employees health care bills direct to doctors).
Different Types of Forms
1095-B (employee copy) and 1094-B (transmittal like a W3) Insurance companies file these as well as those small businesses that are self insured.
1095-C (employee copy) and Form 1094-C (transmittal) are for larger employers with over 50 full time employees (or common ownership of multiple companies that total over 50) will file even if they do not offer health insurance coverage.
Electronic filing is required for those with over 250 employees.
